Right 42. Right to Grand Jury

Section 1

No person shall be held to answer for a serious criminal offense unless on a presentment or indictment of a grand jury.

Section 2

Grand juries shall be composed of citizens and shall review evidence to determine whether sufficient cause exists to bring charges.

Section 3

The government shall present evidence fairly and honestly to the grand jury.

Section 4

Congress and the states may establish procedures governing grand jury proceedings consistent with this right.
