Right 44. Right to Remain Silent

Section 1

No person shall be compelled to testify against themselves in a criminal proceeding.

Section 2

Persons taken into custody shall be informed of their right to remain silent.

Section 3

Statements obtained through coercion or without informing a person of this right shall not be used in court.

Section 4

Congress and the states may establish procedures to ensure the protection of this right.
